IMPORTANT REMINDERS

  • All correspondence must be received through HFSRB’s official email address (dph.hfsrb@illinois.gov).  Correspondence submitted through other emails will not be considered received and will not be processed or reviewed.
  • Applications for Certificate of Need permits, Certificate of Exemptions, and requests for Extension of Financial Commitment, Permit Renewal, and Permit Alteration can be submitted via dph.hfsrb@illinois.gov.  In lieu of this process, applications and requests can be submitted to HFSRB’s principal office:  525 West Jefferson Street, 2nd Floor, Springfield, Illinois 62761.  At this time, all fees associated with the above-referenced applications and requests must be mailed to HFSRB's principal office in Springfield.
  • HFSRB will take no action on any request that requires a fee until the fee payment is received at HFSRB’s principal office.
  • Effective July 1, 2025, revisions to HFSRB’s rules at 77 Ill. Adm. Code 1130 take effect.  These changes center on definitions, technical assistance, fees, extension of financial commitment, permit renewal, and permit alterations.  Applications for permit or exemption, and post-permit transactions received by HFSRB on or after July 1, 2025, will be subject to the new rules and fee requirements.

NOTICE OF AN OPPORTUNITY FOR PUBLIC COMMENT  AND REQUEST FOR PUBLIC HEARING

Following the Illinois Health Facilities Planning Act requirements, notice is hereby given of the receipt of an application for exemption for a change of ownership of Kendall Pointe Surgery Center, LLC, located at 100 West Fifth Street, Oswego, Illinois.  This change of ownership is considered a stock transfer, resulting in no change to the current licensee (#E-009-25).  The fair market value of the transaction is $2,780,500. 

Kendall Pointe Holdings. LLC proposes to sell the majority of its current ownership units in the Facility. Following the transaction. Sports Medicine Funds LLC will hold 31.67% ownership, while SMS Oswego ASC, LLC will hold 31.67% of the facility (down from 39.41% ownership before closing). Xavier Simcock, M.D., will hold 31.67% ownership, and Kendall Pointe Holdings. LLC will retain the remaining 5% ownership (down from 50% ownership before closing). Health Care Development Co., Valley West Medical Center, SC, Michael Coulson, D.O., and Robert Foody, M.D. will no longer have ownership in the Facility post-closing. 

This exemption application was called substantially complete on July 30, 2025.  Written requests (no emails or faxes will be accepted) for a public hearing must be received by the Illinois Health Facilities and Services Review Board by August 14, 2025.    The Application can be viewed at the offices of the Illinois Health Facilities and Services Review Board at the address below, or the State Board’s website https://hfsrb.illinois.gov/
