Public Act 104-0365 (Senate Bill 798)
Amends Section 3 of the Health Facilities Planning Act by revising the definition of "Non-clinical service area" and by establishing new definitions for "Patient care unit" and "Provider". Senate Bill 798 took effect on January 1, 2026, and is now known as Public Act 104-0365. HFSRB staff is revising the application form to incorporate these changes. Public Act 104-0434 (House Bill 1437
Section 3.6(c) of the Planning Act states that any construction, modification, establishment, or change in categories of service of a health care facility funded through an appropriation from the General Assembly and maintained or operated by the Department of Veterans Affairs (DVA) is not subject to the Board. However, DVA is subject to the Board if DVA discontinues a health care facility or category of service. Section 3.6(d) of the Planning Act states that Section 3.6 is repealed on 6/25/26. Section 1-35 of House Bill 1437 amended Section 3.6(d) of the Planning Act and extends the repeal date of Section 3.6 from 6/25/26 to 6/25/29. Public Act 104-0434 took effect on 11/21/25. Administrative Rule Update
On December 19, 2025, the Illinois Secretary of State published the Board’s revised rules for 2 Ill. Adm. Code 1925.
